Abia: Group Drags APC To Court, Obtains Interim Injunction

As a fallout of the recently concluded APC Ward Congresses in the 184 wards in Abia state, a group has dragged All Progressive Congress to court and obtain an injunction restraining APC from receiving or acting upon the purported list of successful candidates of Abia APC Ward Congresses in the 184 wards.

The group who calls themselves as successful ward chairmanship candidates, represented by one Mr. Davies Jumbo and all Successful Local government and State delegates of Abia APC chapter represented by one Engr. John Nnah, in a suit number HUK/31M/2021 by their lawyer L .D. Orji Esq dated 4th Aug.2021 approached the High Court of Abia state of Ukwa Judicial Division Holden at Aba, before Hon. Justice C.H. Ahuchaogu to obtain the order.

In the suit in which APC, Governor Mai Mala Buni (for himself and on behalf of the caretaker/extraordinary convention planning committee APC), RT. Hon. Sunny Goli and 9 others INEC inclusive were joined as defendants/respondents, the presiding Judge after receiving the motion exparte, brought in pursuant to order 3 rules,2014 and section 25 of the high court law of Abia state, gave the following orders after reviewing the address presented to him by the counsel of the 1st and 2nd claimants/ Applicants.

The orders were as follows,

1.That an order of interim injunction is granted restraining the Defendants/Respondents by themselves, agents, servants and privies from receiving accepting and acting on the purported list of successful candidates for the All Progressive Congress Ward Congresses in Abia state from the 3rd to 9th Respondents, pending the hearing and determination of the motion on notice.

2. That interim order is also granted restraining the Defendants/Respondents by themselves, agents, servants and privies from conducting the local government and State Congresses in Abia state, pending the hearing and determination of the motion on notice.

3. That order is equally granted in the interim restraining the 1st and 2nd Respondents by themselves, agents, servants and privies from dissolving or tampering with the duly constituted party structure of the All Progressive Congress in Abia state from the Wards local government and the state led by the 10th Respondent, pending the hearing and determination of the motion on notice.

4. That leave is hereby granted to the claimants/ Applicants to serve the Defendants in this suits by substituted means, to wit: by publishing same in a reputable National Daily Newspaper.

5. That when this order is complied with, it shall be deemed good, proper and sufficient in the circumstance.

The case was adjourned to 18th of August,2021, for report of service.

Meanwhile, Chief Ikechi Emenike, Abia state APC Chieftain has described the group who went to court, as “food is ready politicians in Abia APC”.
